This is a stupendous choice. Neomi Rao is, hands down, the best possible pick for the vacancy on the D.C. Circuit.

Rao was considered a frontrunner for Kavanaugh's seat from the start (see our story right after Kavanaugh was confirmed: ) — she's got a long track record in administrative law, which is a big part of the DC Circuit docket, and deep conservative bona fides

Why does the DC Circuit matter? It's the main forum for big legal fights over executive power and agency actions, and it's long been a springboard to the US Supreme Court — Kavanaugh, Roberts, Ginsburg, Thomas, and Scalia are alumni

Rao had support from now-former White House counsel Don McGahn, whose top priorities were judges and deregulation. From McGahn today: "Her distinguished career makes her uniquely qualified for that court. She will be outstanding and fair."

Opposition to Neomi Rao's forthcoming nomination to the DC Circuit is already pouring in from liberal advocacy groups: "Rao has never seen a regulation she didn’t hate," was one comment

If this nomination for Neomi Rao goes through, then Trump will have to find another head of OIRA; small but powerful office in charge of regulatory review.
